1. Preamble
These terms and conditions govern the contractual relations between Adega Cooperativa de Almeirim, CRL based in Rua do Matadouro Municipal – Apartado 83, 2081-901 Almeirim, hereinafter referred to as " Adega de Almeirim Online Shop ", and the people who wish to make a purchase through the Adega de Almeirim www.adegaalmeirim.pt, hereinafter referred to as "user".
In case of omission of any condition, the accepted customs in the distance selling sector shall be considered according to the rules of the Code of Ethics and Fair Practices Loyal of the AMD – Direct Marketing Portuguese Association.

These terms and conditions define the general conditions of sale, established between the Adega de Almeirim Online Shop and the user, such as: access to the site, ordering, payment method and conditions of delivery of the products.
The Adega de Almeirim Online Shop reserves the right to unilaterally modify, at any time and without prior notice, the layout and configuration of the website, the product catalogue and the conditions required to access and/or use the website. Access to the Adega de Almeirim Online Shop is free and does not require prior user subscription or register.
Alcoholic beverages available for purchase at the Adega de Ameirim shop may only be purchased by individuals who are of legal age to do so, in their country of residence.

It is expressly prohibited to copy, reproduce, modify, display, transmit or disseminate any type of contents available in www.adegaalmeirim.pt.

The user undertakes to make a diligent use and keep secret any access code(s) and user name(s) assigned, in any case, to access the site or the services.
The user shall be liable for damages of any nature that the Adega de Almeirim Online Shop may suffer as a result of his/her failure to comply with any of the obligations he/she is subject to under legal notices. 7. Exclusion of warranties and liability
The Adega de Almeirim’s Online Shop does not guarantee the availability and continuity of the website and services operation and excludes any liability for damages of any kind that may be due to the aforementioned website and services being inoperative.
The Adega de Almeirim’s Online Shop reserves the right to refuse or withdraw access to the site or services, at any time and without notice, at its or a third party's discretion, to users who do not comply with these legal notices or the specific conditions applicable.
8. Ordering online
To make a purchase in the Adega de Almeirim’s Online Shop, the user must register.
Validation of the purchase order assumes that the customer is aware of and accepts the general conditions for contracting and use of the website. The data recorded by the Adega de Almeirim’s Online Shop are proof of the set of transactions made between Adega de Almeirim and the Customer.
Adega de Almeirim reserves the right to change any description, image or other information from the Online Shop catalogue without notice.

9. Product availability
Adega de Almeirim shall honour the orders placed online only within the limits of available stocks and undertakes to deliver the articles ordered as soon as possible.
In case the product is unavailable, Adega de Almeirim agrees to inform the user as soon as possible.
Adega de Almeirim only dispatches on business days. Therefore, weekends or holidays are not accounted for in the estimated delivery date.

10. Prices
Prices of products featured in the Adega de Almeirim’s Online Shop, catalogue include VAT at the applicable legal rate under Portuguese legislation.
Any modification of the type of applicable VAT will be reflected in product prices. After this date, the prices may be amended at any time.
All of the prices indicated in the shop can be changed without prior notice and can be out of stock at any time.
Promotions in the Online Shop are not applicable in the physical store, except when identified as such.
The shipping costs are borne by the customer and calculated according to the product weight, destination and total price of the order.

12. Payment method
The user can choose between the following methods of payment in the Online Shop: credit and debit cards (Visa, Mastercard), ATM (“pagamento de serviços” option) (at any ATM).
Upon receipt of the order data, the user has 48 hours to make the payment. If payment isn’t completed within that period, the order will be cancelled.
When choosing ATM payment, you will receive an email with the necessary data to pay in an ATM or through Homebanking service.
The payment method described as “cash on delivery” is not available in the Adega de Almeirim Online Shop.
The Adega de Almeirim Online Shop will make every effort to ensure maximum confidentiality and security of the data transmitted over the internet. The user can choose between the following methods of payment in the Online Shop: credit and debit cards (Visa, Mastercard), ATM (“pagamento de serviços” option) (at any ATM).

13. Delivery
Orders shall be shipped only after confirmation of stock and payment.
The delivery of orders will be made to the address indicated by the user and in accordance with the carrier's delivery times (Torrestir – Transportes Nacionais e Internacionais S.A.).
Home delivery cannot be done to PO box addresses.
Adega de Almeirim’s Online Shop commits itself to delivering the ordered items as soon as possible.
All orders dispatched by the Adega de Almeirim’s Online Shop should be examined by the customer upon receipt. If any irregularity or damage to the product is encountered, the customer must return it to the carrier, justify the reason for return on the consignment note and immediately inform Adega de Almeirim.

14. Returns
Adega de Almeirim Online Shop allows for the return of products within 14 days after purchase pursuant to Decree-Law 143/2001 and Decree-Law 82/2008 of May 20, 2008. However, upon return, the product has to remain intact (including packaging, labels and back labels provided with the product); otherwise the return is considered without effect. 15. Settlement of disputes
